Several highly publicized cases of suspected elder abuse involving real estate professionals have been in the news lately. Whether true or not, the mention of “Elder Abuse” and “your name” is the last thing you want or need as a professional. It could ruin your reputation and possibly lead to personal financial liability. Realtors and escrow officers must now change how they handle transactions involving a potentially vulnerable person, a substantially unfair transaction, or when working with a fiduciary who is representing a vulnerable person. 

Elder law attorney, Wes Fitzwater, of Fitzwater Meyer Hollis & Marmion will discuss how to spot the red flags of elder abuse and how to avoid liability under the Oregon Elder Abuse Act. You will learn how to identify the two most important red flags: a “vulnerable person” and a “substantially unfair transaction.” You will hear what the attorneys representing Title and Escrow companies are telling their officers, and what escrow will need from you to complete a transaction involving a potentially vulnerable person. Finally, you will learn how to work with clients who have Powers Of Attorney, who are Trustees or Court-Appointed Conservators when the property owner has become incapacitated.
